PLEASE READ OUR TERMS AND CONDITIONS BEFORE BROWSING OUR WEBSITE AND ACCEPTING OUR TERMS

This website (“site”) is provided by Experience Sport Lda, owner of the Experience Sport brand, the Vimeiro Clube Aventura (“VCA”) brand, and the Dolce Clube Aventura (“DCA”) brand and their activities.

This document governs the use of this site and creates a legal and binding agreement between the visitor and Experience Sport, Vimeiro Clube Aventura, or Dolce Clube Aventura.

By remaining on the site, making a purchase or reservation, or accepting our terms, you agree to the terms and conditions for its use.

Changes to the Terms and Conditions

Experience Sport reserves the right to add or modify the terms and conditions of this agreement whenever it deems necessary, so you should review them each time you visit the website or make a purchase.

It is the visitor’s sole responsibility to accept and comply with the terms and conditions when accessing the website.

Experience Sport, through its promotional channels and partners, offers a range of tourist entertainment activities to be enjoyed by the direct or indirect purchaser. These activities are organized, conducted, and produced by Experience Sport Lda and/or reliable and qualified suppliers, under agreements made between each of them and Experience Sport.

Once an activity, activities, or product(s) have been selected (whether directly at Experience Sport’s facilities and its projects (VCA or DCA), through a partner, affiliated stores, a website, or other means), Experience Sport will send you, after payment of the respective price, a proof of purchase (email, voucher, invoice, or other confirmation) that grants you the right to participate in the acquired activity or product.

User Conduct

Experience Sport is not responsible for any inconveniences or damages caused during or by the use of the website, nor for any illegal or inappropriate behavior by visitors.

2. Purchase and Reservation of Activities

2.1. Registering for an activity implies knowledge and acceptance of these terms and conditions.

Reservations should be made as far in advance as possible. To make a reservation, you should contact our services by phone at 261 980 825 (call to national landline), through the website www.experience-sport.com, or via email at reservas@experience-sport.com. You should only consider the reservation confirmed upon receiving confirmation from our services, either by phone call, SMS, or email. On the day of the activity, you must bring proof of payment or any other form of confirmation (voucher or similar) as proof of payment to present to the guide/instructor.

3. Activities

3.1. The Experience Sport offer and activity details are available for consultation on the Experience Sport, Vimeiro Clube Aventura, or Dolce Clube Aventura websites, and can also be provided verbally or sent upon request for information or booking.

3.2. Since activities strongly depend on weather conditions, the scheduled date may need to be changed. The information provided by Experience Sport regarding the duration and type of activity is always an estimate under ideal circumstances, therefore no compensation is due for changes in activities or their schedules.

3.3. Experience Sport reserves the right to cancel activities without any obligation to pay compensation.

3.4. Experience Sport will refund the amount already paid, after deducting costs incurred for organizing the respective activity, in the following cases:

a) The required minimum number of participants for each activity is not met (when applicable);
b) Weather, water conditions, safety, or other factors make the activity impractical;

3.5. Confirmation of activities is usually made one or two days before the scheduled date. Due to weather instability, Experience Sport reserves the right to confirm activities up to 12 hours before their start.

3.6. The right to participate in an activity with the corresponding voucher/proof of purchase ends when:

a) The client does not show up at the location and time indicated in the booking confirmation or as communicated for the activity;
b) The client does not present a valid ticket/voucher/proof of purchase or booking confirmation before the activity starts;
c) According to Experience Sport’s management, the reservation, confirmation, or payment for the respective activity was not made or received. In all these cases, the activity is considered to have taken place, and the voucher loses its validity. This also applies to situations where the activity cannot be performed due to the circumstances described in section 3.2.
d) In case of no-show on the day of the activity, and if the activity has not been fully paid, a fee of €10 per person will be charged (due to activation of insurance, guides, transport, etc.). For vouchers from experience providers such as Odisseias, Smartbox, etc., their rules apply, meaning the voucher will be marked as used with no refund.

3.7. Participants must follow instructions given by the guide/instructor and other Experience Sport staff during and after the activities. Experience Sport is not responsible for any consequences resulting from client misconduct or failure to follow previously indicated rules.

3.8. By participating in an activity, clients accept the inherent risks involved, and Experience Sport cannot be held liable for them.

3.9. Experience Sport is not responsible for any damage or loss of personal equipment (clothing, cameras, video cameras, etc.).

3.10. Experience Sport cannot be held responsible for accidents resulting from participants’ recklessness or failure to follow instructions from guides or instructors.

3.11. Experience Sport cannot be held responsible for acts beyond its control or will, including those of its employees.

If you have any issues on the day of the activity or wish to make a complaint, please contact Experience Sport management directly at geral@experience-sport.com as soon as possible, so that we can analyze and improve our service.

4. Weather Conditions and Technical Unforeseen Events

The execution of activities is subject to favorable technical and weather conditions. If such conditions are not met on the day of the activity and the activities are canceled, you will be offered the possibility to make a new reservation, with the client selecting a new date, always subject to the weather conditions on that day and Experience Sport’s availability. If the client incurs expenses or losses due to a cancellation on the day itself caused by adverse conditions or unforeseen events beyond Experience Sport’s control, Experience Sport cannot be held responsible for these.

5. Risks and Responsibilities

It is the client’s responsibility to ensure that they are in suitable health conditions (physical and mental, etc.) to participate in the contracted activities.

In case of doubt, the client should contact Experience Sport, Vimeiro Clube Aventura, or Dolce Clube Aventura regarding the activity they intend to purchase.

The purchase or reservation of an activity with Experience Sport, VCA, or DCA implies the following from the client:

a) The commitment to inform Experience Sport of any health problems and/or physical conditions that may be affected by the activity or affect its normal execution.
b) The acknowledgment and acceptance that there are inherent risks associated with any outdoor activity involving physical effort and/or taking place in isolated locations, such as hiking, biking, canoeing, stand-up paddleboarding, jeep rides, kart cross, participation in games, team challenges, obstacle courses, and similar.
c) The declaration that the client has the physical capacity to complete the chosen program.

5.1. Restrictions

We ask that any restrictions be mentioned prior to purchase/reservation so that we can take the necessary measures to meet the client’s needs.

5.2. Difficulty Levels

The difficulty level of activities offered by Experience Sport is generally communicated in the activity details or at the time of booking confirmation.

Most of Experience Sport’s offerings are of easy to moderate difficulty, except for hiking trails, bike rides, and/or activities that may require greater physical effort and a minimum physical condition.

6. Payment Terms

Individual Programs: Any activities for individuals can be purchased or reserved via website, phone, email, or in person. The activity can be reserved in advance or paid in full at the time of reservation.

Anything not listed in the program or not mentioned in this section is NOT included.
Experience Sport reserves the right to include a “NOT INCLUDED” section to highlight to the client services that are not included, when deemed especially relevant.

7. Cancellations and Refunds

Experience Sport reserves the right to cancel a program under the following circumstances:

a) Extreme weather conditions that compromise the safe and comfortable execution of the activity. In this case, Experience Sport commits to promptly reschedule the activity. In exceptional cases where a refund is justified, Experience Sport will refund the client.
b) When the minimum number of participants required to carry out the activity is not met. In these cases, registered participants may reschedule or opt to cancel the activity.
c) War or threat of war, terrorism, strikes, fire, natural disasters, and other similar situations beyond Experience Sport's control. In these cases, if circumstances allow, Experience Sport will propose a new date or suggest an alternative program.

Cancellation by the client: Cancellation of any previously confirmed activity will incur charges according to the general conditions:

a) Cancellations up to 30 days before the activity – a cancellation fee of 30% of the total cost applies;
b) Cancellations up to 15 days before the activity – a cancellation fee of 50% of the total cost applies;
c) Cancellations less than 2 days before the activity – a cancellation fee of 100% of the total cost applies;
d) All canceled reservations will incur a fee of 15% of the total reservation value or a minimum fee of €100.

8. Guarantees: Mandatory Insurance and Responsibilities

All risks inherent to the execution of tourism animation activities conducted by Experience Sport are covered by a personal accident insurance policy and a civil liability insurance policy, with coverage as stipulated by current legislation, namely:

i) Payment of treatment expenses, including hospital stays and medications, up to an annual amount of €3,500;
ii) Payment of a capital sum of €20,000 in the event of death or permanent disability of clients, with the death benefit reduced to funeral expenses reimbursement if the client is under 14 years old;
iii) Civil liability insurance covers €50,000 per claim, with the policy guaranteeing damages caused by claims occurring during the policy period, provided claims are made within one year after contract termination.

Note: Any expenses above these amounts cannot be charged to Experience Sport. If you wish to insure the activity for amounts exceeding those contracted and/or stated in the policy, Experience Sport may request a specific proposal from the insurance company.

Experience Sport is not responsible for any damage or accident occurring during activities that are not covered by its Civil Liability Insurance and Personal Accident Insurance taken out on behalf of participants.

All activities conducted by Experience Sport are supervised by qualified professionals.

All Experience Sport activities are subject to a Safety Plan based on the risk assessment of each activity.

a) Insurance is not activated if participants are intoxicated or under the influence of narcotics, drugs, or other toxic substances not prescribed by a doctor;
b) The company is not responsible for any damage or accident occurring during the program or activity that is not covered by legally required insurance.

8.1. Emergency Means Available

Portugal has a national emergency system that can be accessed anywhere in the country by dialing 112, free of charge.

All Experience Sport staff are certified in first aid.

Experience Sport has first aid kits and communication and transport means that can be used by its technicians to call for help (mobile phones, vehicles, cars, bicycles, motorcycles, canoes).

9. Procedures in Case of an Incident

All Experience Sport activities, guided and self-guided, are preceded by a safety and conduct briefing aimed at informing clients about best practices, rules, and safety.

Regarding incidents, there are operational rules that involve costs not covered by Personal Accident Insurance and that everyone must be aware of at the time of booking. The procedures to follow in case of an accident are:

a) The client is responsible for the payment of transportation to the assistance and treatment location whenever the emergency service considers that the nature of the occurrence does not justify the use of an ambulance.
b) Reimbursement of assistance and treatment costs by the insurer is made afterwards, as a refund. Therefore, the injured party must pay all costs related to the services provided.
c) Experience Sport is responsible for filling out and submitting the incident report to the insurer, as well as assisting the injured party in sending proof of immediate assistance and treatment expenses paid by the insured for reimbursement purposes.
d) After this procedure, the relationship between the injured party and the insurer will continue directly, without Experience Sport's involvement.
e) The insurer, depending on the type of incident and assessment of damages, will decide the amounts to reimburse within the coverage limits mentioned in section 6.

10. Equipment: Rental Conditions, Technical Support, and Responsibilities

The client assumes full responsibility for the equipment rented from Experience Sport during the rental period. This responsibility may extend up to the full value of the equipment.

It is the client’s duty to ensure the security of the equipment, among other precautionary measures, whenever the equipment is left unattended or used freely without supervision. The client must guarantee the safety of the equipment.

Equipment must be returned in the same condition as at the time of rental. If the client detects any anomalies upon receipt, they must report them to the monitor.

The rental is carried out with the delivery of all necessary materials to safely perform the activity, except when otherwise stated.

Upon return, if any anomalies or damages are detected, Experience Sport reserves the right to charge a fee for the damage(s) caused.

Although the equipment is delivered in good working order, the client must be knowledgeable about it when reserving and renting, and be able to address and resolve any issues that may arise during use. In the case of bicycle rental, the client should know how to fix minor issues such as changing an inner tube and adjusting gears or brakes. If this condition is not met, an additional fee will be charged for any service call to repair these minor problems.

In guided programs, it is the guide’s responsibility to assist the client in resolving such issues.

Participants assume all risks inherent to the activity they have booked.

It is the client’s responsibility to provide power supply whenever the equipment requires it.

11. Gift Vouchers

Experience Sport, through its projects Vimeiro Clube Aventura and Dolce Clube Aventura, offers the opportunity to purchase gift vouchers.

Once the type of voucher is selected (either directly at the project locations mentioned, through partners, affiliated stores, websites, or other means), Experience Sport will send you, after payment, a voucher granting the right to participate in the purchased activity.

The voucher must be presented on the scheduled day of the activity.

11.1. Purchase of the Voucher

If, for any reason, your voucher does not reach the recipient, we will send a new voucher at no additional cost (valid only for email deliveries), and the lost voucher will be cancelled.

11.3. Voucher Booking

Activities associated with gift vouchers must be booked in advance. Reservation requests should be made in person, by phone, SMS, or email at the respective projects.

Activities are only reserved after receipt of confirmation.

The voucher must be presented on the scheduled day of the activity.

11.5. Voucher Description

Therefore, unless otherwise stated in writing prior to the activity, participants grant all rights and authorize the use of photos and videos taken during the activities and the periods before and after them, for posting on the website and sending audiovisual material to all clients, as well as for marketing and advertising actions by Experience Sport or its partners. All copyright rights are reserved by Experience Sport.

13. Inquiries and Complaints

Experience Sport responds to any inquiries about its activities via email or phone within a maximum period of 2 to 5 days. Failure to respond may mean that the inquiry or complaint did not reach us.

Our clients’ opinions are important to us. If you have any suggestions or complaints, please do not hesitate to present them, as this is the best way to improve our service and satisfactorily resolve any disputes.

In case of a problem during a program, the client should immediately contact one of their guides or monitors.
